Agenten jag pratade med på SAS idag kunde inte lova att jag skulle få någon ersättning om jag avbokade min biljett och köpte en ny biljett med tex Norweigen. Jag hänvisade till de €300 men hon ville ändå inte lova något eftersom det var en award. Hon sa att man kan få avslag. Hur som helst så var det inte aktuellt eftersom det inte fanns någon biljett för under 5800kr (ARN-LLA).
Hon försökte pusha mig att avboka biljetten och få tillbaka 6000p och 406kr i skatter. Jag valde att sitta kvar med bokningen och ansöka om enligt EU261/2004. Det verkar dock som att SAS inte kommer ge med sig och man får driva det till rätten då dom hävdar att alla strejker är extra ordinärt. Något jag kommer bestida då en personal som strejkar ej är utom ens kontroll.
Detta fick en vän idag.

I understand your request for compensation. However, in accordance with EU regulation 261/2004, compensation is not payable.
Article 5 in EU regulation 261/2004 provides that “an operating air carrier shall not be obliged to pay compensation in accordance with Article 7, if it can prove that the cancellation was caused by extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken". "All measures" has not been interpreted to mean an airline must do everything in its power to avoid delay, only what is reasonable.
In the preamble to the regulation, a strike is specifically pointed out as an extraordinary circumstance and SAS took all reasonable measures in order to avoid the cancellations and delays. Already the 18th of April, 7 days before the strike was a fact, we started to offer worried passengers an option to voluntary rebook their tickets in order to get to their destinations in time. Also, SAS secured that 30 % of the planned flights still could operate according to schedule. Since SAS took all reasonable measures in order to avoid the cancellations and delays, I am sorry to say that we can't meet your request of compensation.
