Dear SAS Customer Service,
According to SAS website and your own limits of liability it states that you follow the Montreal Convention.
https://www.sas.se/misc/check-in/limits-of-liability/
The Montreal Convention can be found here:
https://www.iata.org/contentassets/fb1137ff561a4819a2d38f3db7308758/mc99-full-text.pdf
Article 17, paragraph 3 in the Montreal Convention states:
“If the carrier admits the loss of the checked baggage, or if the checked baggage has not arrived at the expiration of twenty-one days after the date on which it ought to have arrived, the passenger is entitled to enforce against the carrier the rights which flow from the contract of carriage.”
My luggage did not arrive at the expiration of twenty-one days after the date on which it ought to have arrived. The bag arrived on July 26:th and I landed at Arlanda on June 25:th. That is a delay of 31 days.
Can we agree on the facts above?
If yes please proceed with my claim for compensation. The fact that the bag was delivered does not change anything when it comes to SAS liability. The baggage is considered to be lost after 21 days. From what I understand, the limit of liability for SAS is 1 131 SDR which is about 16 165 SEK according to
https://www.xe.com/sv/currencyconverter/convert/?Amount=1131&From=XDR&To=SEK.
My claim is 1 131 SDR to be paid out to my account in ABC XXXX XXXXXXX immediately.
If no, please let me know so I can start the legal process of claiming my rights.
Best regards,
XXXX
