Dear Madam or Sir,
I am referring to the cancelled flight of LH2454, MUC-OSL, on 21 May 2014. The cancellation resulted in a delay to my final destination of over 3 hours. The distance between MUC and OSL is less than 1500 km and as such I am requesting compensation under Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004, specifically Article 5(1)(c), of €250 as stipulated by the regulation (Article 7(1)(a)).
I conferred with ground staff at MUC airport to elucidate the cause of the cancellation and I was told on site that the delay was due to technical issues, and specifically an oil leakage (information from staff in the tower). Such a technical issue is not deemed as an extraordinary circumstance that could not have been avoided even if all reasonable measures had been taken (ref. ECJ Case C-549/07 Wallentin-Hermann v Alitalia), and Lufthansa is as such obliged to provide compensation of €250. Lastly, I was not informed about the decision in due time in order for the Regulation to not apply for compensation.
