De brukar vara snabba och hjälpsamma. Har en liknande situation nu på fredag då jag ska till Berlin med en kompis.
EG261/2004 skiljer inte mellan strejk och strejk.Det är inte 100% säkert eftersom vad som räknas till extraordinära omständigheter avgörs från fall till fall. Exempelvis är en flygledarstrejk alltid en extraordinär omständighet. Strejk av piloter eller annan ombordpersonal är tydligen mer tveksamt.

Article 5.3 provides that the air carrier shall not be obliged to pay compensation if it can prove that the cancellation is caused by extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken. The Regulation gives the following examples of extraordinary circumstances: political instability; bad weather; security risks; unexpected flight safety shortcomings; strikes that affect the operation of an air carrier and air traffic management decisions.

The German Federal Court of Justice (BGH) strengthened the airlines rights in its judgment dated 21.08.2012, ref. X ZR 138/11. Passengers claimed compensation because of flight cancellations resulting from pilot’s strikes. Though regulation (EC) No 261/2004 awards compensation for cancelled flights, the airline was freed from this obligation, as the court considered the strike an extraordinary circumstance. The German Federal Court of Justice ruled that strikes, irrespective whether the airline’s employees themselves or the airport’s staff is on strike, are defined as extraordinary circumstances.
